The following terms and conditions apply to all orders placed by yourself, “the customer“, on our website: custommx.co.uk
By placing an order, you agree to be bound by the Terms and Conditions set out herein. Please make sure you have read and understood them before placing your order.
Only persons 18 years or older, or strictly with bill payers permission, can place an order.
We reserve the right to amend these Terms and Conditions without prior notice.
The version of the Terms that will apply to your order will be those on site at the time you place your order.
2. OUR PRODUCTS
All graphics are printed by ourselves, CustomMX, and are not endorsed by any industry manufacturers.
We reserve the right to discontinue any product at any time.
3. PRICES AND DELIVERY CHARGES
The prices displayed include the statutory Value Added Tax (VAT), as set by the UK government. Our VAT registration number is GB177510794
We reverse the right to amend shipping costs or discounts without prior notice.
Product and service prices and/pr promotions listed on our website are subject to change without notice.
If we are unable to deliver your order in full and have to make more than one delivery, there will not be an additional charge for any subsequent deliveries.
Once you have placed your order, you will receive an email confirmation. If for any reason we are unable to fulfill your order, we will let you know at the earliest opportunity. If we have already received payment for such an order, we will attempt to refund the applicable amount using the same method used to make the payment. If for any reason, alternative arrangements are necessary, we will contact you to settle the refund.
All purchases from our website are made pursuant to a shipment contract. The order will be shipped to the address entered when placing the order.
If an error is made and a product is listed at an incorrect price, CustomMX shall maintain the right to refuse or cancel any orders placed at the incorrect price. If the order has been confirmed and charged to your credit card, CustomMX shall immediately issue a credit in the amount of the incorrect price.
5. PAYMENT METHODS & INFORMATION
Please be sure to provide the exact billing address and telephone number that your credit card provider has on their database – this will ensure no delays in processing your order. This is the most common reason for a card payment failing during the checkout process.
During the checkout process, you will be asked to enter your payment details. Where you are using either Debit/Credit card or Paypal. By completing your payment details, you confirm that the payment method being used is yours and have all required permissions to do so.
Please be advised that where PayPal is used as the payment method, we will pass certain information to the relevant party (name, address, delivery address, email address, and phone number) so that they can process your transaction and provide the service. Once this information has been passed to the relevant party, CustomMX shall remain a data controller and that party shall also be a data controller in relation to that data
All card payments are subject to authorisation by your card issuer. We take full payment immediately for all products.
All products ordered will remain the property of CustomMX until we have delivered the products to the address specified by you or they have been collected from ourselves.
CustomMX exercises the utmost diligence in accepting and processing orders and will endeavour to deliver your order to the address requested by you in your order.
Once you have placed your order, you will receive an email confirmation with your expected delivery details for the whole order.
When we communicate delivery days, we mean working days excluding weekends and public holidays.
CustomMX endeavours to dispatch orders in the fastest possible time. Though we aim to deliver within the communicated time frame, the delivery may take longer due to unexpected events, or beyond our control.
We cannot guarantee any firm delivery dates.
7. INCORRECT ORDER
If you order an incorrect item, for example for the wrong model or tear, and the order has gone to print or dispatched, we will not be able to change your order as all orders are custom made to your own personal specification. However, we will endeavour to work with you to rectify your mistake. Please note that there will be an additional fee for the reprint of these goods, plus the delivery date of the dispatch will change due to this error.
If your order arrives damaged or incomplete or with errors, we must be notified within 7 days of receipt of these goods to info[email protected] or WhatsApp to +447877379824. Any order must be returned complete in the original packaging, along with confirmation of the issue raised.
Credit card refunds are credited back to the card used for the original purchase. PayPal refunds will be issued to the original PayPal account immediately.
These items are excluded from the right to withdraw the order:
CustomMX guarantees a refund of returned items that have not been customised to a customers exactly requirements. If an error has been made by CustomMX, and not the customer, on an order a refund or replacement can be processed. We cannot offer refunds for personalised orders made in error, but we will help in any way we can to rectify an issue at a reduced rate.
10. WARRANTIES AND CLAIMS
CustomMX will repair, replace, reduce the price or give you a refund if the goods you bought are faulty or defective. The same goes for products damaged during transportation.
You must report claims via e-mail promptly when discovering the fault.
CustomMX makes no additional or independent warranty.
CustomMX shall under no circumstances be liable for special, incidental, or consequential damages including loss of profit, even if it has been advised of the possibility of such damages. The maximum liability for all direct damages, if any, arising out of any action shall be limited to an amount not to exceed the purchase price of the product.
11. OUR RESPONSIBILITY
Nothing in these Terms shall exclude or limit CustomMX liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability.
CustomMX is not responsible for indirect losses which are a side effect of the main loss or damage, for example, loss of profits or loss of opportunity; or for failure to deliver the goods or to meet any of our other obligations under these Terms where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident, and terrorist activity.
Our maximum liability to you for any loss or damage arising in connection with your order on CustomMX shall be limited to the total price of your order.
